This is not about "judging" experience or degree of relative "emergency." 
The point we're going to be soon missing is NOT how you got into a "fix," but whether you're "way out" was, relatively speaking, limited to a cell phone. The message being sent in the New Hampshire law is that "Have cell, will travel!" is NOT a tolerable preparation for  backcountry travel.

(So again, it's *not* how you got *into* the mess, but whether your preparation for backcountry emergency was limited to carrying a c*** ph***.)

I know it might really grind on the SAR folks to be out there for three nuts, 100yd off the trail, but to me, the pro who pushes the weather or his abilities is just as nutty..maybe more cause the greater level of experience should make them more aware of possible danger.  Equal treatment.....equal charges.
