NPS uses independent local appraisers. NPS has no power to change the zoning
or classification of the land other than trying to convince the state or
local government to change it. In the case of Saddleback I believe that LURC
controls what can or can't be done and they have already ruled on how much
expansion of the ski area is permitted. Breens are asking for more than is
currently permitted.

But dealing in real estate is a crapshoot and anyone doing it should be
aware of the risks. Perhaps the ED laws should have a component that depends
on the length of ownership. Longevity might provide a lower bound on
compensation - for instance, based on average value over the last ten years.
Not that it would prevent forcing a sale, but whose compensation depended on
it. It also might be reasonable to distinguish between corporate and single
ownership. The ED laws, like most laws set out to do something necessary or
reasonable, but then screw up the details through a combination of political
pressures and ignorance of the possible future effects of unforeseen
circumstances.
