Even the stupid try. I was on a grand jury that was doing first pass to see
if the county had a case against the defendants.

The defendant came into a bodiga and tried to sell a calculator to the
owner. The owner took a look and realized that it looked a lot like one he
had at home. He told the defendant to wait here while he went home to get
some cash. When he got home he saw that his house had been burglerized and
his calculator was gone. He returned to the store with the police and
surprise - the defendant was still there.

The other cases we heard were almost as stupid.

For most of them they should have been prosecuted for being stupid not for
violating a law which they were too stupid to understand. Hopefully the
penalty for conviction of being stupid is a lot of structured training to
get them to be a productive member of society, if necessary in a group home
setting.
