Two  or  three  decades  ago  I  attended  a meeting aimed at Maine lawyers that
addressed  this  issue. The speaker traced the English "common law" to the Roman
conquerors  of  Britain.  And  argued  that  the rights extend far higher on the
landscape  than  courts  have  recognized.  Attorneys at the meeting didn't seem
impressed. But I was.
